1. Acceptance of Terms
1.1. Logimart ("we" or "us") provides its Services (as defined below) to you, subject to this Terms of Service form. The Services are intended for use and offered only to the registered user, whether a local community member, world-wide member, or world-wide guest ("User"/”Customer”,"you" or "your"). By accepting these Terms or by accessing or using the Services or our website located at http://www.logimart.com (the “Site”), you acknowledge that you have read, understood, and agree to be bound by these Terms. The Website acts as a repository for information provided by airlines, shipping liners, shipping Agents, who provide shipment services and collectively called as “AGENTS” or “SERVICE PROVIDER”. If you are entering into these Terms on behalf of a company, business or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these Terms, in which case the terms “you” or “your” shall refer to such entity and its affiliates. If you do not have such authority, or if you do not agree with these Terms, you must not accept these Terms, and may not use the Services.
1.2. We reserve the right, at our sole discretion, to change or modify portions of these Terms at any time. If we do this, we will post the changes on this page and will indicate at the top of this page the date these terms were last revised. We will also notify you, either through the Services user interface, in an email notification or through other reasonable means. Any such changes will be effective immediately. Your continued use of the Services after the date any such changes become effective constitutes your acceptance of the new Terms.
1.4. You are responsible for maintaining the confidentiality of your password and account, if any, and are fully responsible for any and all activities that occur under your password or account. You agree to (a) immediately notify Logimart of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session when accessing the Services. Logimart will not be liable for any loss or damage arising from your failure to comply with this Section. We reserve the right to refuse access to the Services, terminate accounts, remove or edit content.
1.5 We will use reasonable endeavors to ensure that availability of the Services will be uninterrupted and that transmissions will be error free. However, due to the nature of the Internet, this cannot be guaranteed and we reserve the right to withdraw or amend the Services without notice. Also, your access to the Services may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction. For the avoidance of doubt we will not be liable if for any reason our Services are unavailable at any time or period.
1.6. In addition, when using certain Services, you will be subject to any additional terms applicable to such Services that may be posted on the Services from time to time. All such terms are hereby incorporated by reference into these Terms.
1.7 Trademarks www.logimart.com and other marks indicated on our Website are trademarks or registered trademarks of Logimart globally. www.logimart.com graphics, logos, page headers, button icons, scripts and service names are the trademarks or trade dress of ours. Our trademarks and trade dress may not be used in connection with any product or service that is not www.logimart.com, in any manner that is likely to cause confusion among Customers or in any manner that disparages or discredits us. All other trademarks not owned by us that appear on the Website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by us.
2. Scope of our Service
Through the website, we (Logimart, its affiliate (Shipping Agents) partners) provide an online platform through which all types of logistics services (for example Cargo shipping, Air Chartering, Warehousing etc. collectively the "service(s)"), can respond to Quote requests posted by users who have a Cargo Shipment to be done. By placing a job confirmation Order through logimart.com, you enter into a direct (legally binding) contractual relationship with the Service provider/Agent at which you place the Order. From the point at which you make your job confirmation, we act solely as an intermediary between you and the Service provider, transmitting the details of your Order confirmation to the relevant service provider and sending you a confirmation email for and on behalf of the Service provider.
When rendering our services, the information that we disclose is based on the information provided to us by the Service provider and you. As such, the Service providers are given access to an extranet through which they are fully responsible for updating all rates and other information which will be stored and disclosed to you through our website when a job confirmation is done on the website. Although we will use reasonable skill and care in verifying it, but cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our website or otherwise), inaccurate, misleading or untrue information or non-delivery of information. Each service provider remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information (including the rates and availability) for the service. Our website does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level, qualification or (star) rating of any services made available.
Our services are made available for personal and commercial use. Therefore, you are not allowed to re-sell, deep-link, use, copy, monitor (e.g. spider, scrape), display, download or reproduce any content or information, software, products or services available on our website for any different competitive activity or purpose.
3. Description of Services
3.1. The “Services” include (a) the Site, (b) Logimart’s “Request for quote”, “Comparative Quote Display” and “Job Order Confirmation” , “Track Shipment” Services for shipping cargo, and (c) all software (including the Software, as defined below), data, reports, text, images, sounds, video, and content made available through any of the foregoing (collectively referred to as the “Content”). Any new features added to or augmenting the Services is also subject to these Terms.
3.3 “Comparative Quote Display” is the comparative online display of cost by Agent/Agents in response to a Customer’s Request for Quote for shipping his cargo as described in the web form/E-mail/Telephonic conversation with a Logimart logistics coordinator.
3.4 ”Job Order Confirmation” is referred to the process when a user accepts any of the Quotation provided by an Agent in response to his request and simultaneously places Order confirming his intent to award the job of shipping his cargo to the respective Agent. The user will have pay certain %age of the total quote amount while confirming the job Order as mentioned against the Quote display. The balance amount due to the Agent/Service provider can be directly paid to them or can be routed through us.
3.5 “Track Shipment” is referred to the service provided through Logimart where a Registered User/Customer who has confirmed a job Order is able to track his shipment status through the website. The tracking information will be either provided by the Agent or be available through 3rd party tracking mechanism tools.
4. Prohibited products
4.1. These are the types of products that, for everyone’s safety, Logimart simply cannot handle quote requests pertaining to them.
4.2. Logimart is not liable for any loss, damage, destruction of products resulted to be prohibited. In this case the responsibility is only of Logimart’s client who has requested a quote service from the Logimart site.
5. Access and Use of the Services.
5.1. In Order to use the Services you must register with us. To register with us you must be an individual of at least 18 years of age or a commercial entity, in each case with valid evidence of identity, the proof of which will be collected by our Logistics Coordinators while verifying your account on Logimart.com. To register with us you must ensure that all the details provided by you on registration or at any time are correct and complete. You must inform us immediately of any changes to the information that you provided when registering by updating your details were provided on the Website or by contacting us.
5.2. In addition to (and without limiting the generality of) the other Terms and conditions of these Terms, You will not use the Services to (or assist another person to):

You understand that the operation of the Services, including Your Content, may be unencrypted and involve (a) transmissions over various networks; (b) changes to conform and adapt to technical requirements of connecting networks or devices and (c) transmission to Logimart’s third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to operate and maintain the Services. Accordingly, you acknowledge that you bear sole responsibility for adequate security, protection and backup of Your Content. Logimart will have no liability to you for any unauthorized access or use of any of Your Content, or any corruption, deletion, destruction or loss of any of Your Content.
5.5. The failure of Logimart to exercise or enforce any right or provision of these Terms shall not be a waiver of that right. You acknowledge that these Terms of Services form is a contract between you and Logimart, even though it is electronic and is not physically signed by you and Logimart, and it governs your use of the Services and takes the place of any prior agreements between you and Logimart.
5.6. Subject to the terms hereof, Logimart may (but has no obligation to) provide technical support Services, through email in accordance with our standard practice.
5.7. Change of information. Logimart’s client can change Order details (for example address, declaration, etc.) or cancel an Order ONLY until complying with Logimart Order Cancellation policy.
5.1. Usage Fees
Usage of the site is FREE OF CHARGE for Users/Registered Customers. Usage is generally free for Agents/Service providers until notified otherwise by us.
For those Agents/Service Providers who utilise paid services in using the Services, your use of the Services is conditional upon your making payment of all costs, fees, charges, expenses, and subscription fees that may be levied from time to time on your usage of the Services, unless otherwise agreed in writing. In particular paid services warrant and undertake that they shall make payment of all such costs, fees, charges, expenses, and subscriptions fees from the point the service is availed, unless otherwise agreed in writing and acknowledge that in our sole discretion, we reserve the right to suspend or terminate an account and access to the Services, where payment of services has not been made in accordance with the above;
For those Agents/Service Providers who have a subscription for the Services, the subscription will last as mentioned in the contract for them or the time span as notified on the web site for that particular subscription. Users who have a subscription for the Services can terminate their account with us on thirty (30) days prior written notice. Subscription fees are payable in full and in advance and are non refundable, even in the event of an early termination of a subscription. Subscriptions are renewable at the time when the subscription ends, however where a subscription User fails to renew their account after a period of thirty (30) days from the expiry of that subscription, we reserve the right to terminate their account.
5.3 Job Order Confirmation Amount
On the acceptance of a quotation by an Agent/Service Provider for a particular request, the User/Customer will have to pay a certain %age of the total quote amount as mentioned in the Website to confirm his Job Order with the particular Agent. The User/Customer needs to pay balance amount which is the Quotation amount minus the Job Order Confirmation Amount directly to the Agent/Service Provider on timelines as described in the Terms of the Quotation of the Agent.
5.4 Payment methods
Logimart.com shall endeavour to provide the User with facilities/gateways to pay the Job Order Confirmation Amount through credit cards (visa and MasterCard), debit cards, demand drafts, pay orders, cheques or direct bank transfer. The Website will permit you to make payments through it for the Services. We will (a) provide, in connection with it, such security methods designed to protect the confidentiality of payment information as we think appropriate, (b) ensure that functionality will be made available to users who comply with the steps which we may require (which may include proving to us that the user has signed an agreement with a bank which can process those payments), (c) not under any circumstances be liable for any errors in the payment transactions (including the failure of those transactions) and any payment due to us will remain payable until we have received cleared funds in our bank account.
The Job Order Confirmation Amount is non-refundable.
By making a Job Order Confirmation with an Service provider/Agent, you accept and agree to the relevant cancellation policy of that service provider, and to any additional (delivery) terms and conditions of the service provider that may apply to your job, including for services rendered and/or products offered by the service provider (the delivery terms and conditions of a service provider can be obtained with the relevant quotation). Please check the quote details thoroughly prior to making your job confirmation.
7. Intellectual Property
Unless stated otherwise, the software required for our services or available on or used by our website and the intellectual property rights (including the copyrights) of the contents and information of and material on our website are owned by Logimart, its suppliers or providers. logimart.com exclusively retains ownership of all rights, title and interest in and to (all intellectual property rights of) (the look and feel (including infrastructure) of) the website on which the service is made available (including the guest reviews and translated content) and you are not entitled to copy, scrape, (hyper-/deep)link to, publish, promote, market, integrate, utilize, combine or otherwise use the content (including any translations thereof and the guest reviews) or our brand without our express written permission. To the extent that you would (wholly or partly) use or combine our (translated) content (including guest reviews) or would otherwise own any intellectual property rights in the website or any (translated) content or guest reviews, you hereby assign, transfer and set over all such intellectual property rights to logimart.com. Any unlawful use or any of the aforementioned actions or behavior will constitute a material infringement of our intellectual property rights (including copyright and database right).
8. Third-Party Liability
By using the Logimart Services, you acknowledge and agree that Logimart disclaims all liability for the acts or omissions (including, without limitation, any negligence or willful misconduct) of any third party whether or not selected by or retained by Logimart.
9. Governing Law and Venue
14.1 Use of the Services is governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates any proceeding with respect to or in connection with the Services must be brought in that jurisdiction.
